These Terms govern your access to and use of ArtistResults.com, app.artistresults.com, and any associated web or mobile applications (collectively, the ‘Service’ or ‘Platform’) operated by Artist Results, LLC.
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Definitions
- Content: Any files, data, or materials you upload, submit, store, create, or transmit through the Service, including but not limited to music WAV files, video files, images, metadata, contact information, email content, social media posts, and any materials used in your Electronic Press Kit (“EPK”).
- EPK: The Electronic Press Kit feature that compiles and publicly displays or hosts your selected Content (music, videos, images, metadata, etc.) as a marketing piece or artist website.
- Services: The Platform’s features, including secure storage and organization of intellectual property, CRM tools for contact management and email sending (one-off and bulk), social media post creation and scheduling, and EPK generation/hosting.
- Subscription: Your paid recurring access to the Service under one of our pricing plans (details available on the pricing page).
2. Eligibility and Account Registration
You must be at least 18 years old (or the age of majority in your jurisdiction) and capable of forming a binding contract. You agree to provide accurate registration information and keep it updated. You are responsible for all activity under your account and for maintaining the confidentiality of your login credentials.
3. Description of Services
The Service helps artists manage their music business by:
- Storage and Organization: Securely hosting and organizing your intellectual property (WAV files, videos, images, metadata, etc.).
- CRM: Storing contact information and enabling one-off or bulk email communication.
- Social Media: Allowing creation and scheduling of posts to your connected social media accounts (e.g., Instagram, TikTok, Facebook, X, YouTube).
- EPK: Generating a professional Electronic Press Kit that uses your Content for public representation, marketing, or as a standalone artist website. The EPK may be publicly viewable or shareable.
We reserve the right to modify, suspend, or discontinue any feature at any time.
4. User Content and Licenses
You retain all ownership rights in your Content. However, by uploading, submitting, or using Content on the Service, you grant us a non-exclusive, worldwide, royalty-free, fully paid, sublicensable, and transferable license to:
- Host, store, reproduce, format, adapt, modify (as needed for technical display or EPK formatting), publicly display, distribute, transmit, and make your Content available as necessary to provide the Services, including generating and publicly displaying your EPK, sending your emails via the CRM, and posting/scheduling content to your authorized social media accounts.
- Use metadata and technical data to operate, improve, and analyze the Service (in anonymized form where required by law).
This license survives termination only to the extent necessary for us to fulfill legal obligations (e.g., backups) or as otherwise stated. You represent and warrant that:
- You own or have all necessary rights, licenses, consents, and clearances to upload, use, and grant the above license for your Content (including all music rights, sample clearances, publicity rights, and third-party permissions).
- Your Content does not infringe any third-party intellectual property, privacy, publicity, or other rights.
5. Acceptable Use and Prohibited Conduct
You agree not to upload, store, transmit, create, or distribute any Content or use the Service in any way that:
- Infringes or violates any copyright, trademark, patent, trade secret, privacy, publicity, or other intellectual property or proprietary rights of any third party (including uncleared samples or unauthorized music).
- Is illegal, fraudulent, defamatory, libelous, threatening, harassing, hateful, discriminatory, violent, pornographic, or promotes harm, terrorism, or exploitation of minors (including any child sexual abuse material or exploitative content).
- Violates applicable laws or regulations, including anti-spam laws (e.g., CAN-SPAM Act, GDPR, CCPA) for emails sent through the CRM.
- Contains viruses, malware, worms, Trojan horses, or other harmful code.
- Constitutes unsolicited bulk communications (spam), phishing, or uses purchased/rented contact lists without verifiable consent.
- For CRM emails: You must obtain and document all required consents from recipients, honor opt-outs immediately, and comply with all anti-spam, privacy, and marketing laws. We do not review or approve email content; you are solely responsible.
- For Social Media: You must have all necessary account authorizations (via OAuth or similar) and ensure posts comply with the terms of service of the linked platforms. You remain fully responsible for all scheduled or posted content.
- For EPK/Public Display: Content must be appropriate for public viewing and not violate any platform or legal standards.
- Interferes with or disrupts the Service or other users.
- Attempts to reverse engineer, copy, or compete with the Service.
We may (but have no obligation to) monitor, review, or remove Content that violates these Terms. Violations may result in immediate suspension or termination of your account without refund.
6. Intellectual Property
The Service, its design, software, logos, and all materials (excluding your Content) are owned by us or our licensors and protected by copyright, trademark, and other laws. You receive only a limited, revocable license to use the Service during your active Subscription. You may not copy, modify, distribute, or create derivative works of the Service.
7. Subscriptions and Billing
Access to full features requires a paid Subscription. Pricing and plan details are available on our pricing page and may change with at least 30 days’ notice (you may cancel before the change takes effect).
Subscriptions automatically renew at the end of each billing cycle (monthly or annual, as selected). You authorize us (or our payment processor) to charge the payment method on file on each renewal date. You are responsible for all applicable taxes. All fees are in U.S. dollars and non-refundable except where required by law.
8. Cancellation, Refunds, and Termination
- Your Cancellation: You may cancel your Subscription at any time through your account dashboard. Cancellation takes effect at the end of the current billing period; the Subscription will not renew for the next period. There are no refunds for any amounts already paid. All payments are fully earned upon receipt and non-refundable.
- Our Termination: We may suspend or terminate your account immediately for any violation of these Terms, illegal activity, or to protect the Service or other users. Upon termination, you will lose access to the Service and your Content may be deleted (we will make reasonable efforts to allow export beforehand where possible).
- After cancellation or termination, you are responsible for exporting your Content before access ends. We have no obligation to retain or provide copies after termination.
